Who Can Sponsor a Family Member?

U.S. citizens may petition for qualifying spouses, children, adult sons and daughters, parents, and siblings. A U.S. citizen generally must be at least 21 years old to petition for a parent or sibling.

Lawful permanent residents may petition for qualifying spouses and unmarried children or adult sons and daughters. Family-based immigration categories generally include:

  • Immediate Relatives of U.S. citizens, including certain spouses, unmarried children under 21, and parents
  • Family Preference Categories, including adult children and siblings of U.S. citizens and qualifying spouses and children of lawful permanent residents

Immediate-relative visas are not subject to the annual numerical limits that apply to family preference categories. Preference cases may depend on visa availability and priority dates.
